These terms and conditions apply to the use of all H.A.G. Import Corpn (Australia) Pty Ltd websites. By placing an order with us, you are agreeing to accept these terms and conditions (the Conditions).

These terms and conditions can change at any time, and it is your responsibility to check them regularly before ordering products in case of changes. If you do not agree with the terms and conditions set out below, you should not use or access these websites.

The following terms and conditions apply between you and H.A.G. Import Corpn (Australia) Pty Ltd when you purchase an item from maxwellandwilliams.com.au. These terms do not affect your statutory rights.

Your Account & Order

Your contract for purchases made through maxwellandwilliams.com.au is with H.A.G. Import Corpn (Australia) Pty Ltd. You undertake that all goods ordered are for your own private and domestic use only, and are not for resale.

You must be eighteen years or older to use this site. If you are under eighteen, you may only use the site under the supervision of a parent or guardian.

You warrant that all details you provide for the purpose of ordering or purchasing goods are true, accurate, current and complete, and that any credit or debit card used is your own with sufficient funds to cover payment. You agree that email may be used as a means of communication, and that you will inform us promptly of any changes to your details.

It is a crime to use a false name or invalid credit card to place an order. Anyone found wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

We reserve the right to terminate our agreement with you and suspend or terminate your access to the site immediately and without notice if:

  • You fail to make payment when due
  • You breach any of these terms and conditions
  • You fail to provide sufficient information, within a reasonable timeframe, to verify the accuracy of information supplied or your identity
  • We suspect you have engaged, or are about to engage, in fraudulent or illegal activity on the site

Indemnity

You agree to fully indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless from and against all claims, liability, damages, losses, costs and expenses (including reasonable legal fees) arising out of any breach of the Conditions by you, or any other liability arising from your use of this website, including use by any other person accessing the site using your account or personal information.

Delivery

Delivery timeframes are at the discretion of our courier partners and are approximate only. It is the customer's responsibility to provide accurate delivery details and to liaise with the courier once an order has been dispatched. For full delivery information, please see here.

Ordering

  • When placing an order, you warrant that all information given is accurate and complete. All orders are subject to acceptance and product availability, as listed on each product's description.
  • All prices listed are correct at the time of publishing; however, we reserve the right to change prices at any time. All prices include sales tax.
  • No contract for sale exists until we accept your order by dispatching the product, confirmed via email detailing the products ordered, payment method, cost (including GST and postage) and usual delivery times.
  • Please check all details on your confirmation email and contact us as soon as possible if anything is incorrect. If an incorrect address causes an order to be returned, resending the order will be at the customer's expense.
  • If your order is not accepted, you will receive an explanatory email. Orders exceeding $500 AUD will be contacted for confirmation by our Customer Service team.

Payment

  • maxwellandwilliams.com.au accepts Visa, Mastercard and American Express. All cardholders are subject to validation checks and authorisation by the card issuer; we are not liable for any delay or non-delivery resulting from a refusal of authorisation.
  • You may remove items from your shopping basket at any time prior to submitting your order.

Cancelling your order

Once your order has been confirmed and invoiced, it cannot be changed. To cancel, please email your request marked "URGENT CANCELLATION" to sales@maxwellandwilliams.com.au, including your name, address and order number.

If your order has already been dispatched, you will need to wait until you receive the product and then follow our Returns procedure.

Once we've received notice of cancellation prior to invoicing, any amount debited will be re-credited within 3 business days.

Privacy

We will not pass on your personal or credit card details to any third party. We will never ask for personal details via email; if you receive such a request claiming to be from us, please contact Customer Service immediately.

Promotional Discount

  • Promotions on maxwellandwilliams.com.au apply only online and do not extend to retail stores or other stockists.
  • Where a promotional code is required, each code is single-use and may only be redeemed once per customer, unless otherwise specified and applies only to qualifying items as outlined in the offer. Promotional codes are non-transferable and may not be resold or exchanged for cash and cannot be used in conjunction with any other offer, promotion or discount.
  • If an item purchased using a promotional code or during a promotional offer is returned, the value of the discount will be deducted from the refund. If minimum purchase conditions are no longer met as a result of a return, the discount value will similarly be deducted from the refund owing.
  • We reserve the right to modify or cancel any promotion at any time, and to decline or refund an order in the event of an error with promotional pricing or conditions. Any violation of these terms will render the promotion invalid.

Liability

  • We reserve the right to change information, prices, specifications and descriptions of products at any time, and do not accept liability for any errors or omissions on our website.
  • If a pricing error is identified, we will notify you and give you the option to confirm your order at the correct price or cancel it. We are under no obligation to fulfil an order at an incorrectly advertised price.
  • If you receive goods that are incorrect, damaged, defective or of a different quantity to that ordered, please notify us in writing and we will honour our obligations under the Australian Consumer Law.
  • We take reasonable care to ensure product images are accurate but are not responsible for minor colour discrepancies between images and the actual product.
  • To the extent permitted by law, we are not liable for any indirect, consequential or economic loss (including loss of income, profit, data or goodwill), or for delays or failures caused by events outside our reasonable control (e.g. natural disasters, strikes, government action).
  • Nothing in these Conditions excludes or limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded under Australian law.

We are not responsible for material displayed on third-party websites. The only prices that apply are those stated on our own site; we cannot vouch for the accuracy of prices listed elsewhere.

 

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of these Conditions. Each provision shall be construed as separately applying and surviving even if any other provision is held unenforceable.

These Conditions govern our relationship with you and constitute the entire agreement between us. Any changes must be in writing and signed by both parties. Nothing in this clause limits or excludes our liability for fraudulent or negligent misrepresentation.

These Conditions are governed by the laws of Australia, and you irrevocably submit to the exclusive jurisdiction of Australian courts.
